1. Heard on prayer for grant of leave to appeal as well as on I.A. No.1/2024- Application for condonation of delay in filling appeal.
2. Learned counsel for the petitioner would submit that the complainant has duly engaged a lawyer before the trial Court, however, on the last date of hearing his lawyer did not informed him about hearing of the case and only informed that his case has been dismissed for want of prosecution and respondent has been acquitted.

4. On due consideration, leave as prayed for by counsel for the petitioner is granted.
5. Let the petition filed by the petitioner be registered as acquittal appeal.

7. Issue notice to the respondent on appeal on payment of PF, as per rules.
8. List the appeal thereafter.
