This is the first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sahita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.55/2025 registered at Jaynagar Police Station, District Surajpur (C.G.), for the offence punishable under Section 21(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Case of the prosecution, in brief, is that Police of Police Station Jaynagar, District Surajpur (C.G.) has received secret information from 2 the informant and on the basis of the said information on 07.02.2025 Sub Divisional Police Inspector of Jaynagar has seized 518 pieces of Onrex Cough Syrup from the joint possession of present applicant and co-accused Ashish Singh @ Golu and during the course of the investigation the applicant has been arrested by the police. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in crime in question. She further submits that Panch witnesses have been examined and have turned hostile. She also submits that 518 pieces of Onrex Syrup has been seized from the possession of the applicant, which fails to qualify as commercial quantity, hence the applicant has wrongly been charged in the present case. It is further submitted that the applicant is in jail since 07.02.2025, conclusion of the trial may take some time, therefore, she prays for grant of regular bail to the applicant. 4. On the other hand, the learned Panel Lawyer opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. He further submits that 518 pieces of Onrex Syrup has been seized from the possession of the applicant, which is more than commercial quantity. As such, the applicant is not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and further the fact that Panch witnesses have turned hostile and also the fact that articles, which have been seized from the applicant is more than commercial quantity, this Court is of the opinion that it is not a fit case 3 to enlarge the applicant on regular bail. Accordingly, the bail application of the applicant – Vikash Singh Rana, involved in Crime No.55/2025 registered at Jaynagar Police Station, District Surajpur (C.G.), for the offence punishable under Section 21(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8.
