Hon’ble Shri Justice Ravindra Kumar Agrawal Order on Board 25.07.2025 1. The petitioner was initially transferred from District Raipur to District Balrampur vide order dated 08.01.2025. The said transfer order dated 08.01.2025 was challenged by the petitioner in WPS No.625 of 2025 in which the coordinate Bench of this Court vide order dated 23.01.2025 directed the petitioner to submit his representation before the authorities concerned within 10 days of the order and the authority, in turn, was directed to decide the said representation within four weeks from the date of receipt of copy of the Digitally signed by MOHAMMAD AADIL KHAN 2 representation. Till decision on his representation was decided, the order under challenge dated 08.01.2025 was directed to be kept in abeyance. 2. In compliance of said order dated 23.01.2025 the petitioner submitted his detail representation on 29.01.2025 raising all his grievances, however, without passing any speaking order his representation was dismissed by one line order dated 09.06.2025 without assigning any reason for rejecting the same. Therefore, the said order of rejection dated 09.06.2025 and and order 13.06.2025 are under challenge in the present writ petition. 3. Learned counsel for the State would fairly submit that although in the order dated 23.01.2025 there was no direction to pass any speaking order, yet the authorities concerned may be directed to pass speaking order in the interest of justice. 4. Considering the submissions made by the counsel for the parties, the nature of dispute in the case and also considering the transfer policy prevailing in the State, the impugned orders dated 09.06.2025 (Annexure P/8) and 13.06.2025 (Annexure P/1) are quashed and the matter is remitted back before the respondent No.2 with a direction to pass a speaking order on the representation made by the petitioner on 29.01.2025 in accordance with law on its own merits within a period of three weeks from the date of receipt of copy of this order. The petitioner is directed to produce copy of this order before the respondent No.2 within a week. Till decision of respondent No.1 on the representation of the petitioner dated 29.01.2025, let status quo, as it exists today, be maintained by the parties. 5.
