Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has inter alia prayed for the following reliefs:- “That the respondents may kindly be directed to consider and decide the representation of the petitioner dated 8.9.2021 contained in Annexure P-5 within time bound manner by granting due and admissible compensation to the land taken by the respondents without granting any compensation to the petitioner, within time bound period.” 2. The very factum of the land of the petitioner having been acquired has been disputed by the respondents. This Court is of the 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:39797 considered view that as seriously disputed questions of fact are involved in this matter, the same cannot be decided by this Court under Article 226 of the Constitution of India as the issues require leading of evidence and the petitioner would be well advised to seek his remedy before the appropriate Court of law. 3. Accordingly, this writ petition is disposed of without adjudication on merit, with liberty to the petitioner to approach the Civil Court for redressal of the issue raised by way of this petition. 4. It goes without saying that the time spent by the petitioner while pursuing this petition shall be taken into consideration which calculating the limitation.
