GP FOR SERVICES II The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 26241/2025 ORDER: The present Writ Petition is filed questioning the Order of Transfer dated 17.09.2025 transferring the Petitioner from ZPHS Hampapuram Village, Rapthadu Mandal to PSHM at MPPS Krishnapuram Village, Bommanhal Mandal, Ananthapuramu District. 2. The Impugned Order of Transfer was passed as the Petitioner did not participate in the counseling process as required under the Andhra Pradesh State Teachers (Regulation of Transfers) Rules, 2025. 3. Learned counsel for the Petitioner submits that the Petitioner is having medical issues and on account of the same, he could not participate in the counseling process. He further submits that there are left over vacancies i.e., PSHM at MPPS, Garladinne Mandal, Ananthapur District and PSHM at MPPS, Kotanka, Garledinne Mandal, Ananthapur District and his case can be considered for posting at those places. 3 4. Learned Assistant Government Pleader submits that as the Petitioner did not participate in the counseling, the Petitioner was transferred in the left over vacancies as provided under Rule 20 (iv) of the Rules referred to above. 5. Having heard the respective counsel, as it is stated that there are left over vacancies at PSHM at MPPS, Garladinne Mandal, Ananthapur District and PSHM at MPPS, Kotanka, Garledinne Mandal, Ananthapur District, the Respondent Authorities are directed to consider the case of the Petitioner for posting in either of two places taking note of the medical condition of the Petitioner within a period of four weeks. Until such time, the Petitioner shall not be relieved from the present post. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
