Neutral Citation No. - 2025:AHC:64482 Court No. - 74 Case :- WRIT - C No. - 9068 of 2025 Petitioner :- Smt. Mansi And Another Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Umair Alam Counsel for Respondent :- C.S.C. Hon'ble Saurabh Srivastava,J.
1. Heard learned counsel for petitioners and learned Standing Counsel appearing on behalf of State-respondents. 2. By means of the present writ petition, a direction in the nature of mandamus directing the respondents not to interfere in peaceful marital life of petitioners, has been sought. 3. At the very outset, learned counsel for petitioner submitted that petitioners have online applied for registration of their marriage on dated 20.03.2025 but till date no registration certification has been obtained by them. 4. Furthermore, a precise query has been raised before learned counsel for petitioner that what is the cause of action for filing the instant petition. In response to the same, learned counsel for petitioner submitted that petitioners are getting threat calls over their mobile phone, whereupon this Court asked the learned counsel for petitioner that whether the mobile number through which petitioners are receiving threat calls is mentioned in the application which has been moved at the behest of petitioner before concerned police authority seeking protection, the same query has been replied in negative. 5. Learned Standing counsel for State vehemently opposed the prayer sought through the instant petition. 6. From perusal of records and submissions advanced by learned counsel for the parties this Court finds that online application for seeking registration of their marriage, was applied by petitioners on dated 20.03.2025 and thereafter, no steps have been taken by petitioners for registration of the marriage in pursuance of online application preferred on dated 20.03.2025. Moreover, from aforesaid discussion it appears that the instant petition has been
preferred as a matter of course by way of raising false allegations which is gross abuse of process of law. 7. Upon perusal of the pleadings, this Court does not find any serious threat perception to the petitioners and, therefore, there is no requirement of passing any order for providing police protection to them. There is no material or reason for this Court to conclude that the petitioners' life and liberty are at peril.
There is not even an iota of evidence to evince that private respondents (relatives of either of the petitioners) are likely to cause physical or mental assault to the petitioners. If any person misbehaves or manhandles them, the Courts and police authorities are there to come to their rescue, but they cannot claim security as a matter of course or right without any serious threat. 8. In view of aforesaid discussions, the instant petition is hereby dismissed.
