Mr. Jaspal Singh Guru, AAG Punjab SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Section 528, The Bharatiya Nagarik Suraksha Sanhita, 2023 for quashing of the order dated 12.02.2024 (Annexure P-4) passed by Ld. JMIC, Ludhiana, whereby, the Petitioner has been declared as Proclaimed Offenders in FIR No. 7, Dated 07.01.2016, U/s 452, 324, 506, 34 of IPC Registered at P.S. Dakha, Distt. Ludhiana (Annexure P-1) whereby the Petitioner was declared as PO by the Court of Ld. JMIC, Ludhiana.
Learned counsel appearing for the petitioner submits that the penalty to the tune of $4000 (Canadian Dollars) or equivalent amount i.e., Rs.2,42,920/- stands deposited with the Punjab & Haryana High Court Bar Clerk’s Association, Chandigarh and in support of which a receipt has been produced, which is taken on record as Mark ‘A’. CRM-M-14472-2025 -2- In the light of above, this petition further would not warrant any
consideration, as the petitioner has already sought three months’ time to return back to India and surrender before the trial Court for ascertaining himself before the trial Court without any default thereafter. Rest of the directions given in the order dated 20.03.2025 would also remain the same including the stipulation that in case the petitioner after his joining the proceedings before the trial Court or at the time of surrender moves an application seeking bail, the same may be considered and decided in accordance with law preferably on that very day itself. The petition stands disposed off, accordingly.
