Mr. Suman Basu …for respondent no.2. Learned counsel for the petitioner submits that the petitioner and the private respondents are co-sharers of the plot in question. The private respondents are raising unauthorized construction therein without obtaining sanction from the concerned Panchayat. Pursuant to a representation submitted by the petitioner before the concerned authority in this regard on 26th February, 2025, notice of hearing was issued by the Pradhan, Kumirmora Gram Panchayat. But no hearing has been held by the authority till date. The petitioner seeks a direction upon the Pradhan to deal with the issue at the earliest. In view of the allegation raised by the petitioner, the Pradhan, Kumirmora Gram Panchayat, being the 8th respondent herein, is directed to consider and dispose of the representation submitted by the petitioner dated 26th February, 2025 within four weeks from the date of communication of this order upon granting reasonable 2 opportunity of hearing to all concerned including the petitioner and the private respondents in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the construction raised by the private respondents is found to be illegal/unauthorized, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
