Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 528 of the BNSS, 2023 in respect of Special (NDPS) Case No. 07/2025 (arising out of Mornoi PS Case No. 74/2024 under Section 22(c)/29 of NDPS Act] now pending in the Court of Special Judge, Goalpara. 3. The petitioner, Sri Nabab Hussain @ Munna is shown as an absconder in the Page No.# 2/2 charge-sheet. He apprehends that he appears before the learned Court below in response to the summons, he will be remanded to custody. 4. Mr. Baruah, learned APP, Assam has objected to the petition on the ground that commercial quantity of narcotic drugs is involved in this case and the petitioner is shown to be an absconder in the charge-sheet. 5. I have considered the submissions made by the learned counsel for both sides. 6. The petitioner submits that he is interested in facing the trial. 7. Since the petitioner is interested in facing the trial, this Court is of the opinion that the petitioner deserves to be given adequate opportunity to that effect. Therefore, his application is allowed. 8. The petitioner, Sri Nabab Hussain @ Munna is directed to appear before the Court of the learned Special Judge, Goalpara in connection with Special (NDPS) Case No. 07/2025 within next 10 days from today and on his appearance, he shall be released on bail of Rs.25,000/-with a surety of like amount to the satisfaction of the learned Special Judge, Goalpara. 9.
