ANJARIA) Heard learned advocate Mr. Sampat Anand Shetty for the petitioners and learned Additional Government Advocate Smt. Niloufer Akbar for the respondents. 2. The present petition is filed by the petitioners, 3 in numbers. The petitioners seek grant of quarrying lease/licence for extracting - 4 - NC: 2025:KHC:4498-DB WP No. 26281 of 2024 building stones in the property bearing Survey No.20 of Doddashettikere Village, Turuvekere Taluka, Tumakuru District which land admeasures 10 Acres. 3. Raising common grievance that their case for grant of the licence is not considered despite similarly situated applicant was favoured, the prayers are made seeking direction against the respondent-authorities of the Department of Mines and Geology to grant quarrying lease/licence in favour of the petitioners in furtherance of their respective applications produced along with the petition which are pending from 12.08.2016. 3.1 It is the case of the petitioners that the applications would survive in view of applicability of Rule 8B of the Karnataka Minor Mineral Concession Rules, 1994, as amended. It is also prayed to direct the authorities to consider the applications in view of the representation dated 05.04.2024 produced on record (Annexure- C1, page 89) and also the Circular dated 28.02.2023. 4. In the representation dated 05.04.2024 aforementioned, it is stated that previous representation was made on 07.09.2023, but no action has been taken. It is further stated that one M/s. Billiton - 5 - NC: 2025:KHC:4498-DB WP No. 26281 of 2024 Mines Wings whose proprietor is H.M. Devaraju, PWD Contractor who is similarly situated person has been granted State Level Environment Clearance but, the case of the petitioners is not attended to. It is stated that the said M/s. Billiton applied for land in the same survey number. 5. In the totality of facts and circumstances when the representations of the petitioners are pending, the petition is disposed of by directing the competent authority-respondent to consider the representation dated 05.04.2024 as well as other representations made by the petitioners by deciding the same within eight weeks from today in accordance with law. 6. It is further observed that since the case of the petitioners inter alia is that their case is similar to M/s. Billiton Mine Wings, while considering and deciding the representations and the prayer of the petitioners, the said aspect shall be duly considered by the competent authority in accordance with law so as to inquire into whether case of the said M/s. Billiton Mine Wings was considered on similar set of facts and circumstances. - 6 - NC: 2025:KHC:4498-DB WP No. 26281 of 2024 7.
