The present Writ Petition is filed seeking to declare the proceedings in Rc.No.301/2013/A1, dated 16.08.2018 issued by the 3rd respondent to the extent of altering the date of regularization of the petitioner from 27.07.1999 to 10.11.1999 and his placement at serial No.123, as illegal and arbitrary and to set aside the same to the extent of the applicant’s regularization date by directing the respondents to restore the date of regularization of the applicant to 27.07.1999 and to consider his case for promotion in the ensuing DPC with date of regularization as 27.07.1999. 4. On 31.08.2018, the Andhra Pradesh Administrative Tribunal passed interim order in O.A.No.1874 of 2018, which is renumbered as W.P (AT) No.2117 of 2021 and the relevant portion of the said interim order is extracted hereunder: “Hence, pending further orders, the impugned proceedings in Rc.No.301/2013/A1, dated 16.08.2018 of the 3rd respondent/ Deputy Commissioner of Prohibition and Excise, Visakhapatnam, are hereby suspended insofar as pushing down the applicant from 27.7.1999 to 10.11.1999 is concerned and the respondents are directed to consider the case of the applicant for promotion to the post of Assistant Excise Superintendent by taking his date of regularization as 27.07.1999.” 5. Learned Government Pleader for Services-II has placed on record the proceedings issued by the 2nd respondent vide CR.No.1133/2019/CPE/B3, 3 JS,J W.P (AT) No.2117/2021 dated 12.04.2019. The petitioner was included at serial No.31 in the final seniority list of Prohibition and Excise Inspectors, Visakhapatnam Division, which was enclosed as annexure-I along with the aforementioned proceedings. 6. In view of the same, no further orders are required in the Writ Petition. 7. Accordingly, the Writ Petition (AT) is closed. No order as to costs.
