[2025:RJ-JP:12261] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. For Respondent(s) : Mr. Amit Poonia, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 18/03/2025
1. Apprehending his arrest in connection with FIR No.94/2024, registered at Police Station Arain, District Ajmer, for the offence(s) under Sections 8/15 of the N.D.P.S. Act, the accused-petitioner has preferred this criminal misc. bail application under Section 482 of B.N.S.S.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the recovery of contraband article was effected from the other co-accused Shaitan Lal, who has already been enlarged on regular bail by the Co-ordinate Bench. Apart from the disclosure statement of the co-accused Shaitan Lal, there are no other substantive evidence available on record showing that the accused-petitioner has supplied the said contraband articles to the other co-accused Shaitan Lal. The present petitioner is ready and willing to co-operate with the investigation, custodial interrogation
[2025:RJ-JP:12261] (2 of 3) [CRLMB-14908/2024] of the petitioner is not required, therefore, the anticipatory bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of anticipatory bail application. It is contended that the petitioner and the co-accused were in regular contact through mobile phone and the co-accused has disclosed the name of the present petitioner. It is also contended that the petitioner was involved in one similar nature of offence under Sections 8/15 and 8/29 of the N.D.P.S. Act and he is a habitual offender, therefore, the instant anticipatory bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on the record. 5. Apart from the disclosure statement of the other co-accused and their connectivity through mobile calls, there are no other substantive evidence available on record showing that the petitioner has supplied the said contraband articles to the main co-accused Shaitan Lal, who has already been enlarged on regular bail. The petitioner is ready and willing to co-operate with the investigation, custodial interrogation of the accused-petitioner is not required and there are no criminal antecedents against the accused-petitioner, therefore, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner. 6.
Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that in the event of arrest of the petitioner- Dinesh Rebari S/o Shri Roopa Rebari, in connection with FIR No.94/2024, registered at Police Station Arain, District Ajmer, he shall be released on bail, provided he
