Notice. Mr. Y.P.S.Dhaulta, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents. 2. With the consent of learned counsel for the parties, the matter is heard at this stage. 3. The case set up by the petitioner is that:- Petitioner is presently serving as Peon (Class-IV) in the respondent Women & Child Development Department; He is eligible for promotion to the post of Clerk under 10%

It has also been asserted that petitioner is senior most Peon (Class-IV ) and further that vacancies under 10% quota, as per applicable R&P Rules are available for promotion of eligible Class-IV employees. Despite this, respondents have not considered the case of the petitioner for promotion to the post of Clerk. 2. In the above background, following reliefs have been prayed by the petitioner.:-
“(i) That the respondents may very kindly be directed to consider the case of the petitioner for promotion for the post of clerk as per R&P Rules under 10% quota after convening DPC as per the R& P Rules. (ii) That the respondents may further be directed to consider the representation of the petitioner Annexure P-1 & P-2 and promote the petitioner for the post of Clerk after convening the DPC on the basis of seniority.”

Learned counsel submitted that the petitioner would be content in case respondent No.2-the Director Women & Child Development, Himachal Pradesh is directed to decide the representation preferred by him on 20.10.2025 (Annexure P-2) within a fixed time schedule. Learned Additional Advocate General is not averse to this prayer. 3
5. Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of with direction to respondent No.2 to consider and decide the aforesaid representation of the petitioner in accordance with law within a period of six weeks from today.
The decision so arrived at shall also be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any. Jyotsna Rewal Dua December 09, 2025
