Petitioner has been made accused in connection with S.T. No. 138 of 2025 arising out of Dhurki P.S. Case No. 165 of 2024 for the offence registered under Section 103(1) of the B.N.S., 2023 and cognizance has been taken for the offence under Sections 103(1) and 3(5) of the B.N.S., 2023, pending in the Court of learned Addl. District & Sessions Judge-I, Nagar Untari, Garhwa.

On 12.12.2024, the father-in-law of the informant went missing. Later on, his dead body was recovered from Gokhuwakhand forest. During the course of investigation, the petitioner and co-accused persons were apprehended and on the basis of their confession, the axe, which was used in committing the murder of the deceased, was recovered.

Learned counsel for the petitioner has submitted that the confessional statement of co-accused Ramesh Singh was recorded first in time and confessional statements of co-accused Tetar Singh and petitioner were recorded subsequently. It was further submitted that co-accused Tetar Singh has been granted bail by a Co-ordinate Bench of this Court.

In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Addl. District & Sessions Judge-I, Nagar Untari, Garhwa, in connection with S.T. No. 138 of 2025 arising out of Dhurki P.S. Case No. 165 of 2024.
