Tiwari, Spl.P.P. 03/ 09.10.2025: Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Nagar Untari P.S. Case No. 61 of 2025, registered under sections 126(2), 115(2), 118(1), 109, 3(5) of BNS, 2023, pending in the Court of learned Additional Chief Judicial Magistrate, Nagar Untari. 3. Learned counsel for the petitioners submits that there is case and counter case between the parties and both sides have received injury and so far allegation of taking photograph is concerned, that is against Wakil Kumar @ Wakil Kumar Prajapati. He further submits that there is general and omnibus allegation so far petitioners are concerned and their name has been disclosed as they are related with the said Wakil Kumar @ Wakil Kumar Prajapati. He further submits that petitioners have no criminal antecedent which is disclosed in para 19 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that petitioners are named in F.I.R. 5. Considering that there is case and counter case between the ( 2025:JHHC:31277 ) parties and both sides have received injury and so far allegation of taking photograph is concerned, that is against Wakil Kumar @ Wakil Kumar Prajapati and the petitioners are said to be related with the said Wakil Kumar @ Wakil Kumar Prajapati and the petitioners have no criminal antecedent which is disclosed in para 19 of the petition. 6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Nagar Untari, in connection with Nagar Untari P.S.
