2. The applicant has assailed the order dated 11.12.2025 passed by learned Sessions Judge, Dehradun in Criminal Revision No. 25 of 2025.
3. It appears that proceedings under Section 164 of the B.N.S. were initiated by the City Magistrate, who, vide order dated 17.11.2025, directed the Station House Officer, Nalapani, Police Station Dalanwala to attach the property in question. Being aggrieved by the said
order, the respondent preferred a Criminal Revision, wherein learned Sessions Judge, vide
order dated 11.12.2025, stayed the operation and effect of the order passed by the City Magistrate.

Learned counsel for the applicant submits that the order dated 17.11.2025 had already been complied with on 02.12.2025 and that the learned Sessions Judge passed the impugned
order without assigning any cogent reasons, rendering the same unsustainable in the eyes of law. It is further submitted that the revisional court, while granting stay, did not take into consideration the factum of prior
compliance, thereby causing prejudice to the applicant.
5. Having heard learned counsel for the parties and upon perusal of the material available on record, this Court finds that the matter requires reconsideration by the revisional court, particularly on the question of interim relief.
6. Accordingly, with the consent of
learned counsel for the parties, the impugned
order dated 11.12.2025 passed by learned Sessions Judge is hereby set aside. The criminal misc. application stands allowed. Both the parties are directed to appear before the Court concerned on 04.05.2026 without fail. On the said date, the interim relief application shall be taken up and decided on merits after affording due opportunity of hearing to both sides.
