[2025:RJ-JP:3958] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 14905/2024 Sachin S/o Rajaram, Aged About 24 Years, R/o Khubpura, Police Station Kudgaon, District Karauli, Rajasthan. (At Present Confined In District Jail Karauli). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Bal Ram Vashisth For Respondent(s) : Mr. N.S. Dhakar, PP Mr. Brijesh Kumar Bhardwaj Ms. Rukmani, SI, Kudgaon, Karauli HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 28/01/2025 1. The instant bail application has been filed under Section 483 of BNSS., on behalf of the petitioner, who has been arrested in connection with FIR No.130/2024 registered at Police Station Kudgaon, District Karauli (Raj.) for the offences punishable under Sections 115(2), 126(2), 351(2), 189(2) & 109(1) of BNS. 2. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Counsel submits that during the course of investigation, allegation of causing firearm has not been found proved. Police filed charge-sheet in this matter for the offences punishable under Sections 115(2), 126(2), 351(2), 189(2), 109(1), 324(4), 110, 118(1), 125, 118(2) & 117(2) of BNS. Petitioner is in custody since 09.11.2024 & there are no criminal antecedents against him. Counsel argues that trial of the [2025:RJ-JP:3958] (2 of 2) [CRLMB-14905/2024] case will take considerable time. Further custody of the petitioner would not serve any fruitful purpose. 3. Learned State Counsel assisted by learned counsel for complainant vehemently opposes the bail application. They submit that both injured-Dharampal & Kaptan Singh received grievous as well as simple injuries. Injured-Dharampal received nine injuries out of which three injuries are grievous in nature whereas injured- Kaptan Singh received six injuries out of which three injuries are grievous in nature. They further submit that empty cartridges have been recovered from the place of incident. 4. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced at bar, more particularly looking to the nature and number of injuries sustained to injured persons as well as recovery of empty cartridges at the place of incident, I do not find it a fit case to enlarge the petitioner on bail. 5. Accordingly, this bail application is dismissed. (ANIL KUMAR UPMAN),J GAUTAM JAIN /130
