Learned counsel for the petitioner by drawing attention of this Court to the supplementary affidavit dated 09.09.2025 submits that the substituted service of notice by publishing the contents of the notice in the daily newspaper Hindustan, Bhagalpur Edition on 17.08.2025 and the daily Hindi newspaper Dainik Jagran, Bhagalpur Edition on 10.08.2025 has been made. Accordingly, the substituted service of notice upon the opposite party no.2 is sufficient. The learned counsel for the petitioner submits that the petitioner seeks permission of this Court to withdraw this criminal miscellaneous petition with liberty to raise the grounds mentioned in the petition at appropriate stage before the appropriate court at this stage.
