GOPALA KRISHNA RAO TRANSFER CRIMINAL PETITION No.103 of 2024 ORDER: The petitioner/husband herein filed the present petition under Section 407 of the Code of Criminal Procedure, 1973, (for short ‘the Cr.P.C.’) seeking transfer of F.C.O.P.No.568 of 2021 on the file of the Judge, Family Court, Vijayawada, Krishna District, to the Judge, Family Court, Guntur, Guntur District, for trial. 2. The case of the petitioner in brief is as follows;: I. The petitioner is the husband of the respondent and the marriage of the petitioner with the respondent was solemnized on 24.02.2011, at Rotary Club, Ponnuru Village, Guntur District, as per Muslim Rites and Customs. During their wedlock period, the petitioner/husband and the respondent/wife were blessed with two (2) children aged about 12 &yl1 years respectively and later, due to the matrimonial disputes between both the spouses, the respondent/wife has been residing separately along with her two children at her parents’ house at Guntur. The petitioner/husband further pleaded that the respondent/wife lodged a complaint in Crime No.58 of 2020 under Sections 498-A, 324&506 I.P.C. and Sections 3 & 4 of the Dowry Prohibition Act, 1961, before Old Guntur Police Station. After completion of investigation, it has been numbered as C.C.No.3336 of 2022 on the file of the VI Additional Junior VGKR,, ► ^ Tr.Crl.P.No.103 of 2024 Dated 20.06.2025 ^ 2 Civil Judge, Guntur and the respondent/wife vide F.C.O.P.No.568 of 2021 Vijayawada, under Section 125 seeking monthly maintenance from the filed a Maintenance Case on the file of the Judge, Family Court, of the Criminal Procedure Code respondent/wife and she also filed a Domestic Violence Case vide D.V.C.No,36 of 2021 on the file of the Special Mobile Magistrate, Guntur and adjudication before the competent Courts at Guntur. those cases are pending for 3. Heard learned counsel appearing on both sides on record. Perused the material available on record. 4. 5: It was admitted by the learned record that both the parties connected cases i.e., C.C.No.3336 of 2022 D.V.C.No.36 of 2021, are pending before the competent Courts at Guntur F.C.O.P.No.568 of 2021, is pending before the Judge, Family Court Vijayawada, against which the F.C.O.P.568 of 2021, from Vijayawada to Guntur. 6. On considering the submissions made by petitioner and respondent since both the all other connected cases that there are justifiable grounds petitioner/husband, seeking transfer of F.C.O.P. counsel appearing on both sides are currently residing at Guntur and the other F.C.O.S.No.20 of 2024 and on and at present petition is filed for seeking transfer of the learned counsel for the parties are residents of Guntur and are pending at Guntur. I am of the considered viview to consider the request made by the No.568 of 2021 on the file of VGKR, J Tr.Crl.P.No.103 of 2024 Dated 20.06.2025 3 the Judge, Family Court, Vijayawada, Krishna District, to the Judge, Family Court, Guntur, Guntur District. 7. In the result, the Transfer Criminal Petition is allowed and F.C.O.P.No.568 of 2021 on the file of the Judge, Family Court, Vijayawada, Krishna District is hereby withdrawn and transferred the same to the Judge, Family Court at Guntur, Guntur District. The learned Judge, Family Court, Vijayawada, Krishna District, shall transmit the case record in F.C.O.P.No.568 of 2021, to the Judge, Family Court at Guntur, Guntur District, duly indexed expeditiously as possible preferably within a period of two (02) weeks from the date of receipt of a copy of the order.
