The case of the petitioner in brief is that the petitioner is the absolute owner of Ac.4-34 cents of agricultural land in Panagal Village, Srikalahasti, which was inherited from his father as ancestral property. Due to interference from family members, petitioner filed O.S.No.429 of 2000 and the same was partly decreed in his favour. However, he filed A.S.No.3 of 2006 against the dismissal portion and the same was dismissed due to non payment of process fees. Thereafter, a suit for specific performance i.e., O.S.No.224 of 2005 was filed against the petitioner and the dismissed, but the plaintiffs succeeded in A.S.No.8 of 2010, leading to his further appeal S.A.No.588 of 2015 and in which the petitioner obtained a stay of execution proceedings. same was While the suit for specific performance was pending, the same plaintiffs filed O.S.No.106 of 2007 against the District Collector to prevent issuance of Pattadar Passbooks in favour of the petitioner and the same was also dismissed. Meanwhile, his ownership was officially recognized and Pattadar Passbook and Title Deed bearing Patta No.586 were issued in 2002. When a third party, Bakthavasthalam, fraudulently obtained a Pattadar Passbook for Ac.0.20 cents, the petitioner successfully appealed before the Revenue Divisional Officer, Tirupati and the same lead to cancellation of the illegal passbook and re-confirmation of his ownership. From then, the petitioner has been in continuous possession and cultivation of the land. However, on 3 22.10.2016, officials from the Department of Development of Udyanavanam attempted to plough the petitioner’s land without any prior notice, claiming the land as part of 20 acres leased by Sri Kalahasti Institute of Technology for flower garden development. A legal notice dated 01.11.2016 was issued by the petitioner to the concerned authorities, but no proper response was received from the respondents. Aggrieved by the same, the present writ petition is filed. Heard Mr. T.Lakshminarayana, learned counsel for the petitioner 3. and the learned Government Pleader for Endowments appearing for the respondents. On hearing, learned counsel for the petitioner submits that the 4. petitioner is in physical possession and enjoyment of the subject lands till date. But however, the respondent without issuing any notice, without conducting any enquiry, without giving any opportunity is trying to dispossess the petitioner from the subject property. He further submits that report was not served on the petitioner if the report is served, they will challenge the same before the competent authority. Hence, the learned counsel for the petitioner requests to pass appropriate orders. 5.
