THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioners have sought for the following reliefs:- “a) Quash the charge sheet filed by Respondent No.1 in Crime No.6/2024 of Chikkaballapura Town Police Station for the offence punishable under Sections 498A, 306 r/w 34 of IPC and consequently registering the case in SC No.58/2024 pending on the file of III Addl. District and Sessions Judge, Chikkaballapura against the Petitioners in the above case in the interest of justice and equity.” - 3 - NC: 2025:KHC:6164 CRL.P No. 10616 of 2024 2. Learned counsel for the petitioners – accused Nos.1 to 4 and learned counsel for 2nd respondent – complainant have filed a Joint Affidavit duly signed by the petitioners, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioners – accused Nos.1 to 4 and respondent No.2 are physically present before the Court and they admit the contents of the Joint Affidavit, which reads as under:- “We, (1) Venkataravana R.K., aged 36 years, S/o Krishnappa L., R/at Police Quarters, Prashanthnagar, Chikkaballapura District, (2) Mrs. Narayanamamma, aged about 62 years, W/o L. Krishnappa, (3) Mr. Krishnappa L., aged about 63 years, W/o Lakshmipathy, no.2 to 4 are R/at K. Raghuttahalli village, Kotagal Post, Chintamani Taluk, Chikkaballapura and (5) Pulaganti Srinivasa P.N. S/o Late Pulaganti Narayanappa, aged about 55 years, r/at Chelur village, Bagepalli Taluk, Chikkaballapura Dist. now come down to Bangalore do hereby solemnly affirm and state on oath as follows: 1. We state that daughter of No.5 of us is married to No.1 of us. No.2 to 4 of us are mother in law, father-in law and sister in law of deceased Varalakshmi P.S. daughter of No.5 of us. 2. We state that daughter of No.5 of us is suffering from psychiatric problem and due to which she has committed suicide. No. to 4 of us have not abetted the - 4 - NC: 2025:KHC:6164 CRL.P No. 10616 of 2024 commission of the offence. Due to mistake No.5 of us has given complaint against No.1 to 4 of us stating that they have abetted the commission of offence of suicide. In fact No.1 to 4 of us have not committed the alleged offence of abetment of suicide including cruelty to the daughter of No.5 of us. 3. We state that at the intervention of elders and well- wishers we have amicably settled the disputes and there is no grievance against each other in the above case. Due to psychiatric problem daughter of No.5 of us has committed suicide. 4. We state that we have entered into compromise and the said compromise is voluntary one and there is no coercion or undue influence from anybody. On the basis of this affidavit, No.5 of us has agreed to compromise the case and No.5 of us has no objection for quashing the above case against No.1 to 4 of us. We, therefore pray that joint affidavit filed by us kindly be accepted and consequently the case against No.1 to of us kindly be quashed in the interest of justice and equity.” 4. In view of the aforesaid settlement entered into between the petitioners and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Affidavit dated 10.02.2025. - 5 - NC: 2025:KHC:6164 CRL.P No. 10616 of 2024 (ii) The proceedings in S.C.No.58/2024 (arising out of Crime No.6/2024 of 1st respondent – Police) registered for the offences punishable under Sections 498-A, 306 r/w. 34 of IPC, pending on the file of III Additional District and Sessions Judge, Chikkaballapura, insofar as the petitioners are concerned are hereby quashed.
