1. This is the 2nd round of litigation. Petitioner has filed the present writ petition challenging the order dated 23.06.2025, Annexure P1, and order dated 27.08.2024, Annexure P2, whereby, petitioner has been transferred from Digitally signed by V PADMAVATHI Date: 2025.08.20 10:20:44 +0530
Wps 8036 of 2025 2 Industrial Training Institute (ITI) Rajnandgaon to ITI Bijapur, and his representation has been rejected.

Learned counsel for the petitioner would submit that petitioner has been transferred vide order dated27.08.2024, and at that time, he was attached to the Election Duty, He challenged his transfer order by filing WPS-5624 of 2024, which was disposed of vide order dated 11.09.2024 permitting the petitioner to move a detailed representation before respondent-1/competent authority raising all his grievances, and in turn, respondent-1 shall decide the representation of the petitioner within the stipulated time frame in accordance with applicable rules and Circulars. The representation of the petitioner has been decided on 23.06.2025 and it was rejected, which is under challenge in the present petition. He would further submit that the old aged parents of the petitioner are suffering from various ailments, including heart disease. Petitioner himself is suffering from heart disease, and also underwent Coronary Angiography & Coronary Angioplasty (Annexure P6). Looking to his ailments, and also considering the difficulties of his old aged parents, petitioner may be posted at any nearest place to his present place of posting, whereas, he has been transferred to Bijapur, which is far away from Rajnandgaon. He would further submit that petitioner may be permitted to make fresh representation before respondent-1 raising his grievance of ailments, and requesting for his posting to any nearer place, where the post is vacant, and then, respondent-1 may be directed to take decision on the representation of petitioner considering the difficulties of the petitioner, and also vacant posts available at nearer place. On the other hand, learned counsel for the State would submit that they have no objection, if such a direction is being made to the respondent authorities to take decision on the representation of petitioner within the stipulated time frame in accordance with law in view of the difficulties of the petitioner, as raised in the present petition. 4. Heard learned counsel for the parties, and perused the documents annexed with the petition. 5.
Considering the submissions made by learned counsel for the parties, also considering the documents annexed with the writ petition, present petition is disposed of at this stage, directing the petitioner to make fresh representation before respondent-1 along with copy of this order within two weeks from today, and in the event of filing of fresh representation, the same shall be decided within further time of three weeks, keeping in view the difficulties raised by the petitioner, and also available vacant posts at nearer place, if any. 6. Till the decision of representation of the petitioner, status quo as on today, with respect to posting of the petitioner, shall be maintained. 7.
