Order 07/05/2025
1. By way of filing this writ petition, a prayer has been made for issuing direction to the Rent Tribunal, Gangapur City to decide the eviction application submitted by the petitioner expeditiously, within a period of six months.
2.
Learned counsel for the petitioner submits that the said application was submitted by the petitioner on 10.05.2024, wherein after notice, reply has been filed by the respondents at the stage of framing of the issues, therefore, appropriate direction be issued for speedy disposal of the said application.
3. Heard and considered the submissions made at the Bar and perused the material available on record.
4. The eviction application has been submitted in the month of May, 2024 and the proceedings of the Tribunal are progressing in a proper way, with a manageable pendency, hence, under these
[2025:RJ-JP:19244] (2 of 2) [CW-1568/2025] circumstances, no priority can be given in the instant matter only because the petitioner has approached this Court seeking the same direction.
5. Recently, the Hon’ble Apex Court in the case of High Court Bar Association Allahabad Vs. State of Uttar Pradesh & Ors. while deciding Criminal Appeal No.3589/2023 has held that the Constitutional Court should not fix a time bound schedule for disposal of a case pending in any Sub-ordinate Court and has deprecated this practice of issuing such direction by the Constitutional Court to the Sub-ordinate Court, unless such exceptional circumstances are there to meet the extraordinary situation.
6. In the instant writ petition, no such exceptional circumstances are there to meet the extraordinary situation, hence, under these circumstances, a time bound schedule for disposal of the suit cannot be fixed by this Court.
7. However, looking to the fact that the matter relates to the eviction, it is expected from the Rent Tribunal to make all possible endeavours to expedite the proceedings of the application, without entertaining any unnecessary request for adjournment by either side.
8. The instant writ petition stands disposed of accordingly. All application(s) (pending, if any) also stand disposed of.
