The petitioner has filed the present writ petition challenging his transfer order dated 30.06.2025, whereby who is working as Veterinary Assistant ALOK SHARMA Digitally signed by ALOK SHARMA Date: 2025.07.16 17:23:23 +0530 2 Surgeon (VAS) has been transferred from Block Pithora, District Mahasamund to Veterinary Hospital Hatkondal, District Kanker on administrative exigency. 2. Learned counsel for the petitioner would submit that the transfer of the petitioner is against Clause 3.6 and 3.13 of the transfer Policy dated 05.06.2025. He would further submits that the place from where the petitioner is being transferred only two Veterinary Surgeons were posted including the petitioner one Deepak Agrawal has been relieved from there for his further studies and only the petitioner was there and he has also been transferred by the impugned transfer order, therefore, there is no Veterinary Surgeon available at Block Pithoura at present, whereas the place at Hatkondal comes under the Block Durgukondal where two Veterinary Assistant Surgeons have already been posted and if the petitioner have jointed there would excess Veterinary Assistant Surgeon which is in violation of Clause 3.6 and 3.13 of the transfer policy. He would further submits that the wife of the petitioner is also posted at Government Higher Secondary School, Gharghoda, Block Pithora and as per the Clause 3.6 and 3.13 of the transfer policy the husband and wife may be posted at the same place as practically as possible for which he has moved his representation on 02.07.2025 before the transfer Committee as provided Clause 8 of the transfer policy dated 05.06.2025 which is still pending for consideration before the authorities concerned. 3. On the other hand, learned counsel for the State opposes. However, she would further submits that the authorities concerned of the transfer committee are going to decide the representation of the petitioner very soon. 3 4. I have heard learned counsel for parties and perused the material annexed with the petition. 5. Considering the submissions made by learned counsel for the parties, considering the issue raised by the petitioner in his representation and challenge the transfer order further considering that the representation of the petitioner is already pending before the transfer committee since 02.07.2025, the transfer committee is directed to take a decision on the representation of the petitioner within three weeks from today in accordance with law considering the provisions of Clause 3.6 and 3.13 of the transfer policy dated 05.06.2025. 6. The petitioner is directed to produce the copy of this order to the transfer committee within a week from today, till then status quo shall be maintained by the parties with respect to the petitioner’s transfer. 7.
