The petitioner is apprehending his arrest in connection with Hunterganj P.S. Case No. 18 of 2024, corresponding to G.R. No. 473 of 2025, registered under sections 354, 500, 501, 504, 506, 509, 34 of the I.P.C. and section 67, 67(a) of the I.T. Act, pending in the Court of learned Judicial Magistrate, Ist Class, Chatra. 3. Learned counsel for the petitioner submits that petitioner is not named in F.I.R. and allegations are against one Amresh Kumar who has taken the name of the petitioner. He further submits that the petitioner has no criminal antecedent which is disclosed in para 16 of the petition. He submits that petitioner has replied the notice under section 35(3) of BNSS, 2023. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that this petitioner has assisted the said Amresh Kumar in taking photograph of the girl. 5. Looking into contents of F.I.R, it transpires that nothing has been alleged against the petitioner and all the allegations are made against Amresh Kumar. It has been pointed out that petitioner replied the notice ( 2025:JHHC:31086 ) under section 35(3) of BNSS, 2023 and in that view of the matter, the petitioner is directed to surrender before the learned court within two weeks from today and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper. 6.
