HONOURABLE SRI JUSTICE RAVI NATH TILHARI HONOURABLE SRI JUSTICE CHALLA GUNARANJAN CIVIL MISCELLANEOUS APPEAL NOs.554 & 561 of 2010 COMMON JUDGMENT: (per Hon’ble Sri Justice Challa Gunaranjan) I.A.No.297 of 2010 was filed by wife seeking maintenance in DOP.No.683 of 2009 and similarly minor children represented by the wife filed I.A.No.298 of 2010 seeking maintenance towards their education and other expenses. 2. The above applications were filed by the wife under Section 36 of the Indian Divorce Act seeking maintenance pending divorce proceedings. 3. By Common order dated 23.06.2010, both the applications were allowed partly, directing the respondent to pay a sum of Rs.15,000/- to meet the school admission fee, uniforms, books etc., a sum of Rs. 5,000/- towards legal expenses and a sum of Rs.3,000/- each was granted for wife and two children towards monthly maintenance during the pendency of the proceedings from the date of filing of these petitions. Further respondent was directed to pay the school admission fee, uniforms, books etc., and legal expenses on or before 09.07.2010 and also pay the maintenance @ Rs.3,000/- per month to each of them on or before 10th of every calendar month. Aggrieved by the same, husband preferred CMA.No.554 & 561 of 2010. 2 4. This Court while admitting these appeals passed interim order dated 26.07.2010 by which the maintenance @ Rs.3,000/- for each respondents herein has been reduced to Rs.2,000/- per month. Further retained the other amounts awarded towards educational expenses. 5. No representation for the appellant even in the revised call. 6. The matters pertain to the year 2010 and are listed in the weekly cause-list. 7. In view of the above, the Civil Miscellaneous Appeals are dismissed for “non-prosecution” and interim order dated 26.07.2010 granted earlier stands vacated. 8. Copy of this order shall be sent to the concerned Court namely the Principal District Judge, Nellore to place on record in D.O.P.No.683 of 2009. No order as to costs.
