1. The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for issuance of directions to the respondent to decide the case No.PCH-306-2020 titled as “State Vs. Amar” in a time bound manner arising out of FIR No.27, dated 21.01.2019, under Sections 406 & 498-A IPC, registered at Police Station Women Police Station, Chandigarh (Annexure P-1).

Learned counsel for the petitioner submitted that respondent No.2, who is the husband of the petitioner was earlier declared as P.O. and thereafter, he appeared but again he defaulted in appearance and rather he was granted exemption from appearance twice but thereafter on 20.12.2024 non-bailable warrants were issued against him for 28.03.2025 and on that date also he had not appeared. He further submitted that the prayer in the present petition is for issuance of a direction to learned trial Court to expedite the trial.

CRM-M-14025-2025 -2- Chandigarh has submitted that in pursuance of the orders passed by learned JMIC on 20.11.2024 whereby non-bailable warrants have been issued against respondent No.2/accused, efforts were being made to arrest him but the same could not be done. He also submitted that he has instructions to state that all efforts will be made to produce him on the next date of hearing in accordance with law.

Learned counsel for the petitioner has submitted that in view of the aforesaid statement made by learned State Counsel, the present petition may be disposed of.
