This is First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 129/2025 registered at Police Station – Cyber Range, District – Raipur (C.G.) for the offence punishable under Section 317(5), 317(2), 317(4), 111, 3(5) of BNS. 2. As per prosecution story in brief is thatthe Home Ministry of the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.07.22 11:10:19 +0530 2 government of India made a portal for reporting the cyber crime, the portal facilitated the complaints made by the victims of cyber fraud and also mention the description as to the medium being used for cyber fraud, mobile number and bank account information. The bank account information as mentioned above were to be in nexus with the accused persons who used them for committing cyber fraud. By way of cyber crime reporting at Cyber police station and the information received as to Bank of Maharashtra Branch Raipur had 128 Bank Accounts which were being used for the commission of Cyber fraud and the amounts were being deposited in, subsequently during the investigation of the aforementioned bank account holders and mobile number along with registered KYC of the Bank Account Holders and their numbers were asked to be presented in document form. As the documentation could not be presented and there was no cooperation as to the investigation the investigating police on 26.03.2025 arrested the accused persons and presented them before the learned Court, thereafter the accused were sent to the Central Jail Raipur. 3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. It is submitted by learned counsel for the applicant is that the charges leveled against him just in order to harass him, she had no such bank accounts which can be operated as mule account nor his identity proof has been used with his consent to open any account in any of the bank branches to earn any kind of 3 profit. She also submits that the applicant is a young girl, who is aged about 25 years and she is in jail since 26.03.2025 and conclusion of the trial may take some time, therefore, she prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel, opposes the bail application and submits that there is no previous antecedent against the applicant but the information received as to Bank of Maharashtra Branch Raipur had 128 Bank Accounts which were being used for the commission of Cyber fraud and the amounts were being deposited in, subsequently during the investigation of the aforementioned bank account holders and mobile number along with registered KYC of the Bank Account Holders and their numbers were asked to be presented in document form, present applicant was involved in the said offence as a result present case is of the nature of cyber fraud, by which the complainants suffered of huge amount. Thus, the bail application deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties, nature of dispute and material available in the case diary, it transpires that the present case is of the nature of cyber fraud and applicant was involved in the said crime therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on 4 bail. 7. Accordingly, this bail application of applicant – Ishika Singh, involved in Crime No. 129/2025 registered at Police Station – Cyber Range, District – Raipur (C.G.) for the offence punishable under Section 317(5), 317(2), 317(4), 111, 3(5) of BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
