Heard learned counsel for the petitioner and Mr. Om Anand, learned Standing Counsel for the State-respondents. 2. The instant petition has been filed for the following relief: "issue a suitable writ, order or direction in the nature of mandamus commanding the Consolidation Officer, Mawai Kala, District- Mirzapur to consider and decide the Case No.0022 of 2018 (Computerized Case No.201854165331020022 to 201854165331020037) (Gulab and others vs. Shiv Devi and Others), under Section 9-A (2) of U.P. Consolidation of Holdings Act, 1953 Mauja Suiya Kala, Tappa Upraudh, Pargana Kantit, Tahsil- Lalganj, District- Mirzapur in accordance with law within a period of time specified by this Hon'ble Court." 2. This Court vide order dated 3.4.2025 directed the learned Standing Counsel to obtain instruction in the matter. 3. In compliance of the order of this Court, instruction sent by Consolidation Officer is taken on record. 4. Mr. Om Anand, learned Standing Counsel on the basis of instruction submitted that the proceeding is at the evidence stage and the same shall be concluded expeditiously. 5. Considering the facts mentioned in the instruction sent by the Consolidation Officer, the instant petition is finally disposed of directing respondent no.2/ Consolidation Officer to decide the aforementioned dispute after affording proper opportunity of hearing to the parties, expeditiously preferably within a period of three months from the date of production of certified copy of this order before him.
