JUSTICE N. V. ANJARIA and HON'BLE MR JUSTICE K. V. ARAVIND ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) On 22.04.2025, the following order was passed, "There is gross contempt of Court inasmuch as the directions of the Court passed as back as on 20.09.2023 has not been complied with. The direction was to continue the petitioner herein-Ravindra, as a Gangman in the establishment of Konkan Railway Corporation Limited. There is blatant disregard of the direction, as the applicant is not continued in service on the pretext that the review application is filed. As noted earlier, the directions are passed as long back as in September 2023. In the circumstances, the Court has no option but to direct respondent No.3-Sri Santosh Kumar Jha, the Chairman cum Managing Director, Konkan Railway Corporation Limited, to remain personally present before the Court on 29.04.2025 to explain the conduct which is evidently contumacious. Learned advocate for the petitioner at this stage states that respondent No.3 will be present personally before the Court on 29.04.2025 at 2.30 pm. It is however provided that if the Order is complied within the meantime and petitioner is continued in service, personal presence of respondent No.3-Sri Santosh Kumar Jha, shall stand automatically exempted. In that event the respondent shall produce the evidence that the petitioner is taken back in service." - 4 - NC: 2025:KHC:17826-DB CCC No. 1021 of 2024 2. Today, when the contempt petition came up for consideration, learned advocate Mr. Omkar Kambi for the respondents stated that the memo is filed showing the compliance and that the complainant has been reinstated and the same is communicated by registered post. Office Order dated 25.04.2025 is produced in which, it is stated that reinstatement will be subject to the final result in Review Petition No.203 of 2024. 3. In the aforesaid view, learned advocate for the complainant states that the complainant would approach the authorities and shall join the duty in view of the posting order already given. 4.
