Order
[2025:RJ-JP:10700] (2 of 4) [CRLMB-6075/2024] 04/03/2025
1. These three bail applications under Section 483 of BNSS have been filed on behalf of the petitioners herein, who have been arrested in connection with FIR No.118/2024 registered at Police Station Vigyan Nagar, District Kota City (Rajasthan) for the offences punishable under Sections 302, 34 IPC.
2.
Learned counsel representing the accused-petitioners submit that the accused-petitioners have falsely been implicated in this case. It is submitted that the petitioners are totally innocent. They are in custody since their dates of arrest whereas trial will take considerable time in its conclusion. It is contended that the accused petitioners have been roped in this case on the basis of some CCTV footage of the cameras installed nearby the place of incident. Arguing the bail application filed on behalf of accused petitioner Naveen Meena @ Bittu, learned counsel Shri Samarth Sharma contends that he is not named in the FIR. While pressing the bail application of the accused petitioner Yogesh Kumar Meena, learned counsel Ms. Shahzadi Bano, Associate to Mr. Mohd. Ali, Advocate, argues that there is no specific allegation against the petitioner in the FIR and only suspicion has been raised. No specific role has been attributed qua him in the FIR.
Learned counsel Shri Ashwani Kumar Chobisa representing the accused petitioner Aryan Singh submits that neither the accused petitioner Aryan Singh is named in the FIR nor any specific role has been attributed to him in the charge sheet. It is thus, prayed
[2025:RJ-JP:10700] (3 of 4) [CRLMB-6075/2024] that the accused petitioners may be released on bail during pendency of trial.
3. Per contra, learned Public Prosecutor opposes the
submissions made by the counsel for the petitioners. She submits that in the CCTV footage, recovered during the course of investigation, petitioners Yogesh Kumar Meena and Naveen Meena are clearly visible, giving beatings to deceased. She submits that all the accused petitioners actively participated in the crime.
4. I have considered the contentions.
5. As per the CCTV footage analysis, which forms part of the charge-sheet, the petitioners Yogesh Kumar Meena and Naveen Meena are seen causing beatings to the deceased. Both were identified by complainant Laxminath. Thus, having regard to the totality of the facts and circumstances of the case and role attributed to them in the charge sheet, I am not inclined to enlarge these two accused petitioners on bail. Accordingly, the bail applications filed on behalf of the accused petitioners Naveen Meena and Yogesh Kumar Meena are dismissed.
6. However, considering the arguments advanced by learned counsel representing the accused petitioner Aryan Singh and looking to the fact and circumstance of the case in totality as well as charge sheet, without commenting anything on the merits/demerits of the case, it is deemed appropriate to accept bail application of the accused petitioner Aryan Singh. Accordingly, the bail application (No.15075/2024) is accepted. It is directed that accused-petitioner Aryan Singh S/o Shri Surendra Singh shall be released on bail provided he furnishes a personal bond in the
[2025:RJ-JP:10700] (4 of 4) [CRLMB-6075/2024] sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
7. The observation made hereinabove is just for decision of these bail applications and would not prejudice trial in any manner.
