1. This is first bail application filed by the applicant under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of bail as he has been arrested on 09.03.2024 in connection with Crime No. 598 /2023 {Sessions Trial No. 211/2023} registered at Police Station Sakri, District Bilaspur (C.G.) for commission of offence punishable under Section 307 read with Section 34 of the Indian Penal Code.

Allegation against the present applicant in the instant case is that he and his son Kharru Baghel were cutting tree of the field (Badi) of complainant Sukhram @ Ballu Baghel, which was objected by him, therefore, applicant and co-accused threatened to kill him and assaulted him by means of axe, as
2 a result of which, complainant sustained lacerated wound over his head (parietal region) and lacerated wound over chest region also, complainant/victim was admitted in CIMS Hospital, where he remained for two days, thereafter he got discharged. Based on above facts, present crime has been registered against the applicant and his son for the offence under Section 307 read with Section 34 of the IPC. The applicant was arrested on
09.03.2024.

Learned counsel appearing for the applicant would submit that the applicant and the victim are neighbours and the dispute arose due to a trivial issue of cutting of trees, which is situated over the Government land. He further submits that in an altercation took place between the parties, only simple injuries were sustained to the victim, which are not dangerous to life, due to which he remained hospitalized only for two days. He would further submit that similarly situated co-accused person namely Kharru Baghel has already been released on regular bail by this Court vide order dated 22.01.2024 passed in M.Cr.C. No. 109 of 2024 and case of the present applicant is not very serious from him, charge-sheet has already been filed; conclusion of trial is likely to take considerable time, hence, the applicant may be enlarged on regular bail. 4. Per contra, learned counsel for the State opposes the bail application. However, he submits that as per case diary, no criminal antecedents have been reported against the applicant. 5. I have heard learned counsel for the parties and perused the case diary with utmost circumspection. 6. Medical report of complainant /victim does not show any grievous injuries caused to him, rather it has been reported to be simple in nature; charge-sheet has already been filed; conclusion of the trial is likely to take considerable time
3 and the fact that the applicant is in detention since 9.3.2024. Hence, considering the totally of the facts, I feel inclined to grant bail to the applicant. 7. Accordingly, the bail application is allowed. It is directed that the applicant shall be released on bail on his furnishing one personal bond for a sum of Rs.25,000/- alongwith one surety in the like sum to the satisfaction of the concerned trial Court on the following conditions :- (i) He shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court, (ii) He shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) He shall appear before the trial Court on each and every date given to him by the said Court till disposal of the (iv) He shall not involve himself in any offence of similar nature in future.
