[2025:RJ-JP:3409] (2 of 3) [CRLMB-14856/2024] Order 23/01/2025 These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.34/2024 registered at Police Station Karvar District Bundi for the offence under Section 420, 419, 467, 468, 471 and 120-B of IPC. Learned counsels for the petitioners submits that the accused petitioners have falsely been implicated in this case. Counsel further submits that offences alleged to have been committed by the petitioner are triable by Magistrate. The accused-petitioner is in custody since 08.12.2024 and the trial of the case may take considerable time further trial of the case will take time, therefore, the petitioner may be enlarged on bail. Per contra, learned Public Prosecutor opposes the grant of bail application and contended that all the petitioners were hand in glove with each other and sold the property of deceased Kanhaiyalal and petitioner Ramniwas representing himself as Kanhaiyalal. The said property was registered in the name of Fori, Meera Bai, Sugna Bai and Jasoda and petitioners Devlal Mulakraj, Rajendra and Pardhan are directly related to the four ladies and are actual beneficiaries.
It is also contended that Dev Lal was involved in various other criminal activities and against him five criminal cases were registered in police station Karwar, therefore considering the above facts, their bail application deserves to be dismissed. Heard and perused the material available on record. [2025:RJ-JP:3409] (3 of 3) [CRLMB-14856/2024] Considering the arguments advanced by the counsel for the parties and looking to the fact that the petitioners are in custody since 08.12.2024 and charge sheet has already been produced further the case of the petitioner is triable by Magistrate, without expressing anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioners 1. Ramniwas S/o Govindram @ Gomaram, 2. Devlal S/o Shojilal, 3. Mulakraj S/o Shoji, 4. Rajendra S/o Bhanwarlal, 5. Pradhan S/o Harkaran, in connection with FIR No. 34/2024 registered at Police Station Karvar District Bundi shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing as and when called upon to do so. The accused- petitioner Devlal S/o Shojilal is directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner to the trial court every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Magistrate.
