Heard the parties.
The petitioner has been made accused in connection with Giddi P.S. Case No. 15 of 2025, for the offences registered under Sections 65(2) of the B.N.S., 2023 and Section 6 of the Protection of Children from Sexual Offences (POCSO) Act, pending in the court of learned Additional Sessions Judge-III-cum-Special Judge under POCSO Act, Hazaribag. On 12.02.2025, the petitioner is alleged to have overpowered the victim and took her to an isolated place and raped her. It was submitted that there is delay of 20 days in lodging of the F.I.R. It was further submitted that the medical report does not support the allegation. It was further submitted that the doctor has not given any opinion regarding the fact whether the hymen of the victim was found ruptured or not. It appears that the statement of the victim has been recorded during the trial, in which she has supported the prosecution case. However, attention has been drawn towards the statement made by the victim in her cross-examination. It will not be proper at this stage to evaluate the evidence of the victim as it will affect the final disposal of this case. Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected. Learned trial court shall expedite the trial.
