Jasvinder Singh Narula versus Jai Inder Pal Singh Ex. Petition No. 4015 of 2013 06.03.2026 Present: Mr. Neeraj Gupta, Senior Advocate with Mr. Pranjal Munjal, Advocate for the D.H/ applicant. Mr. J.S. Bhogal, Senior Advocate with Mr. T.S. Bhogal, for the J.D/ respondent. OMP No. 1271/2025 Heard. This application seeks revival of the main execution petition by giving details of events that have taken place subsequent to the following order passed in this matter on 02.11.2016 whereunder the proceedings in this execution petitioner were adjourned sine die: “It is jointly represented that in an appeal preferred against the judgment sought to be executed in this petition, a Division Bench .of this Court has ordered to defer further proceedings in this petition. Being so, adjourned sine die with liberty reserved to the parties on either side to move as and when the matter is finally decided by the Division Bench or the interim order is vacated.” It is not in dispute that matter has been finally decided by Hon’ble Division Bench on 03.01.2023 by setting- aside the judgment dated 24.09.2013 rendered by Hon’ble Single Judge in Arbitration Case no. 40/2009 and remanding the case for a fresh decision ( the objection under Section 34 of the Arbitration & Conciliation Act). It is also an admitted position that Special Leave to Appeal (C) No. 10413- 10414/2023, Jasvinder Singh Narula versus Jai Inder Pal Singh, preferred by the petitioner against the judgment dated 03.01.2023 has been dismissed by the Hon’ble Apex Court on 24.07.2023. In view of above, there is no impediment at present in proceeding with the execution proceedings. Accordingly, application is allowed and the execution petition is revived. Application stands disposed of. Ex. Petition No. 4015/2013 List the matter after three weeks. Jyotsna Rewal Dua Judge March, 06, 2026 (yogesh)
