Learned Standing Counsel has filed the instructions today, which are taken on record. Heard learned counsel for the petitioner and learned Standing Counsel. By means of present petition filed under Article 226 of the Constitution, petitioner has questioned the transfer order dated 14th February, 2025. It is argued on behalf of the petitioner that petitioner has been transferred on certain complaints made in respect of which preliminary fact finding enquiry were conducted and petitioner stood exonerated. Learned Standing Counsel on the contrary submits that petitioner has already stood relieved pursuant to transfer order dated 14th February, 2025 on 29.3.2025 and has yet not joined at transferred place. Having heard learned counsel for the respective parties and having perused the records, I find that the petitioner has been transferred on administrative ground. While it may be true that certain complaints made were examined but the administrative authorities know better how to make administration of the establishment workable. In such circumstances, therefore, if transfer order has been passed in administrative exigency, this Court may not interfere in the matter, moreseo, when petitioner has already stood relieved, in the given facts and circumstances of the case, I refused to grant indulgence in the matter. However, in the event petitioner joins at the tranferred place within a period of two weeks from today, his representatin for repatriation or transfer at the place of his choice may be considered in accordance with law. Petitioner may make representation after joining within a period two weeks from today, the same shall be considered representation in the light of circular issued from time to time by police establishment headquarters, by the competent authority, namely respondent no. 2 within a further period of three weeks.
