The present petition under Article 227 of the Constitution of India has been filed seeking direction to the Court of Principal Judge, Family Court, District Kushinagar place Padrauna to decide the execution case no. 1410 of 2020 under Section 128 Cr.P.C. (Kiran Devi vs. Chhatthu Kharwar) expeditiously within stipulated time as fixed by this Hon'ble Court. As per the report furnished by learned Principal Judge, Family Court, Kushinagar at Padrauna dated 13.5.2025, recovery warrant/non-bailable warrant has been issued against the respondent on 12.9.2024. It appears from the record, the petitioner herself has not appeared before the Court on several dates fixed. Considering the facts and circumstances of the case, in case, the petitioner moves fresh application for expedite of the execution proceedings, the same may be considered and decided by the Principal Judge, Family Court, Kushinagar at Padrauna expeditiously.
