[2025:RJ-JP:75] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No.14796/2024 Deepak Kumar S/o Shri Lalluram, Aged About 37 Years, R/o Gadwas Khohra Malawali, P.S. Laxmangarh, Currently Residing Atv H. No. 12/13, Ram Nagar Colony, Bhagore, Rajgargh Road, P.S. Sadar, District Alwar Rajasthan. (Presently Confined In Central Jail Tonk) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Hemant Kumar Sharma, Adv. For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 02/01/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.395/2021, registered at Police Station Baroni, District Tonk for the offence(s) under Sections 420, 467, 468, 470, 471, 474 and 120-B of IPC. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is argued that the accused-petitioner has not induced the complainant though, the said amount was deposited in the account of the accused- petitioner. The main allegation of cheating and inducement are against the other co-accused Hansraj and Manraj. The accused- petitioner is in custody since 16.10.2024 and the charge-sheet has already been produced. In similar nature of allegations, the Co- [2025:RJ-JP:75] (2 of 3) [CRLMB-14796/2024] ordinate Bench in S.B. Criminal Miscellaneous Bail Application No.14805/2024 has enlarged the accused-petitioner on bail vide order dated 11.12.2024, therefore, considering the above facts, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the accused-petitioner has received Rs.5,20,000/- in his account and it is alleged against the accused-petitioner and the other co-accused that they on the pretext of giving job to the complainant have induced the amount of Rs.5,20,000/- from him. It is also contended that the accused- petitioner remained absent during investigation and charge-sheet was submitted under Section 299 of Cr.P.C. against him, therefore, considering the long absence of the accused-petitioner, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case, the accused-petitioner is in custody since long and the investigation/trial of the case may take considerable time, furthermore the matter is exclusively triable by Magistrate, therefore, considering the above facts, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Deepak Kumar S/o Shri Lalluram, in connection with FIR No.395/2021, registered at Police Station Baroni, District Tonk, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance [2025:RJ-JP:75] (3 of 3) [CRLMB-14796/2024] before the Court concerned on all the dates of hearing and as and when called upon to do so.
