Mr. Mohar Pal Meena, Adv. Mr. Subhash Chand Khandelwal, Adv. Mr. Vijendra Yadav, Adv. For Respondent(s) : Ms. Arti Sharma, Dy. G.A. HON'BLE MR. JUSTICE ASHUTOSH KUMAR Order 22/04/2025 1. The present bail applications have been filed by the accused- applicants under Section 483 of the B.N.S.S, 2023 against the orders dated 19.11.2024, 26.11.2024 & 15.02.2025 passed by learned Additional Sessions Judge No.10, Jaipur Metropolitan First (Headquarter-Sanganer) in connection with FIR No.1145/2024, registered at Police Station Muhana, District Jaipur City South for the offences punishable under Sections 310(2) and 324(2) of BNS, by which the bail applications of the accused-applicants under Section 483 of BNSS, 2023 have been dismissed. 2. Learned counsel for the accused-applicants submit that the accused-applicants have falsely been implicated in this matter. Learned counsel argue that there is no criminal antecedents of the [2025:RJ-JP:16880] (3 of 4) [CRLMB-14813/2024] accused-applicants. Learned counsel also submit that the accused- applicants namely; Deepak Balai S/o Ramjilal, Ankit Meena S/o Shri Shivcharan Meena & Rohit Saini @ Rinku S/o Shri Jhootharam Saini are in judicial custody since 26.10.2024 and accused- applicant Lokesh S/o Babulal is in custody since 27.10.2024 and since then, they are behind the bars. Learned counsel contend that the accused-applicants are young persons, charge-sheet has been filed and trial will take long time to conclude, therefore, the accused-applicants be enlarged on bail. 3. On the other hand, learned Public Prosecutor opposes the bail applications and submits that the charges have been levelled for the offences punishable under Sections 324(2), 115(2), 127(2), 310(5), 311, 317(3), 313 & 310(2) of BNS, 2023, which are serious in nature, therefore, the bail applications of the accused-applicants be rejected. 4. Heard learned counsel for the parties and also perused the material available on record. 5. Having regard to the facts and circumstances of the case and considering the fact that the accused-applicants are behind the bars since long and the fact that the charge-sheet has been filed and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail applications filed by the accused- applicants. 6. Consequently, this bail applications filed under Section 483 of the B.N.S.S, 2023 are allowed. It is ordered that accused- applicants namely; 1. Deepak Balai S/o Ramjilal, 2. Ankit Meena S/o Shri Shivcharan Meena, 3. Rohit Saini @ Rinku [2025:RJ-JP:16880] (4 of 4) [CRLMB-14813/2024] S/o Shri Jhootharam Saini & 4. Lokesh S/o Babulal arrested in FIR No. 1145/2024, registered at Police Station Muhana, District Jaipur City South shall be released on bail; provided each of them furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court. Accused-Applicants shall be required to appear before that Court on all dates of hearing and as and when called upon to do so. (ASHUTOSH KUMAR),J Mohita /9-12
