Learned Counsel for the petitioner submits that the petitioner had earlier approached this Court in Crl.P.No.5659/2023 which was dismissed on merits by this Court by order dated 10th August, 2023. Thereafter, there is no progress in the trial, though the petitioner is in custody from 15.09.2020.
