For Applicant(s): Mr.D.Lingeswaran, Administrator General and Official Trustee of Tamil Nadu in both applications ORDER A.No.1135 of 2025 is filed by the learned Administrator General and Official Trustee of Tamil Nadu (hereinafter “AG & OT” for brevity) to permit them to purchase Treadmill – 2 Nos., Elliptical Trainer – 1 No., Spin Bike – 2 Nos., for a sum of Rs.5,40,000/- (Rupees Five Lakh Forty Thousand only) from M/s.Energy Fitness and Sports Company https://www.mhc.tn.gov.in/judis to donate to Nethrodaya at No.47/1, Phase II, Nolambur, Mogappair West, Chennai – 600 037, from the accumulated funds that corresponds to FY 2019-20 and which belong to the Trust Estate of Nagai Visalakshi Ammal. 2.A.No.1137 of 2025 is filed by the learned AG & OT to permit them to purchase SS Wall Mounted Sink – 1 No. and Exhaust System with filter – 1 No. for a sum of Rs.1,18,826/- (Rupees One Lakh Eighteen Thousand Eight Hundred and Twenty Six only) from M/s.Kalam Kitchen Equipment Company to donate to Nethrodaya, at No.47/1, Phase II, Nolambur, Mogappair West, Chennai – 600 037, from the accumulated funds that corresponds to FY 2019-20 which belong to the Trust Estate of Nagai Visalakshi Ammal. 3.In the report submitted in support of the applications, it is stated that the Trust Estate of Nagai Visalakshmi Ammal is being administered by the learned AG & OT as per the Scheme Decree dated 22.02.1915 in C.S.No.363 of 1912. It is stated that, out of the income generated from the Trust, this Court is granting few donations to individuals and organisations in confirmity with the objects mentioned in the Will and Scheme Decree. Nethrodhaya is an organisation serving for Differently Abled Persons, particularly Visually Challenged Persons. The organisation is recognized by Government of Tamil https://www.mhc.tn.gov.in/judis Nadu and approved by Rehabilitation Council of India. It is also registered under Section 51(2) of Rights of Persons with Disabilities Act, 2016 (Central Act 49 of 2016). It is also a Charitable Institution having Income Tax Exemption under Section 80(G) of Income Tax Act. The Institution has also received National Award from Government of India and the founder of the organisation is a recipient of “Best Social Worker Award” from Government of Tamil Nadu. The said organisation Nethrodhaya has approached the learned AG & OT to provide basic fitness equipments which are required for giving physical training to ensure fitness of Differently Abled Children. The founder of the organisation has also sought assistance of the learned AG & OT to help in modernising their Kitchen and to ensure smoke free kitchen which would be conducive to maintain hygienic condition for users. The organisation has given a few quotations received from suppliers of Treadmills, Elliptical Trainers, Spin Bikes for giving physical training to children, and also SS Wall Mounted Sink and Exhaust System with Filter for Kitchen. All the quotations are annexed along with the respective applications. 4.While considering the quotations, this Court is able to see that the fitness equipments that are referred to in the quotations are with different specifications. Therefore, the quality cannot be judged by the prices quoted in the quotations. It is in the said https://www.mhc.tn.gov.in/judis circumstances, the learned AG & OT is permitted to purchase Treadmills and Elliptical Trainers alone, by calling for quotations, and the learned AG & OT is permitted to spend up to a sum of Rs.5,00,000/- (Rupees Five Lakhs only) from the accumulated funds that corresponds to FY 2019-20 and which belongs to the Trust Estate of Nagai Visalakshi Ammal, towards the purchase of the Treadmills and Elliptical Trainers for donating the same to Nethrodhaya. As regards purchase of Kitchen equipments, the learned AG & OT is permitted to purchase SS Wall Mounted Sink – 1 No. and Exhaust System with filter – 1 No., with proper specifications which are recommended for a Kitchen satisfying statutory standards, for a sum of Rs.1,18,826/- (Rupees One Lakh Eighteen Thousand Eight Hundred and Twenty Six only) from M/s.Kalam Kitchen Equipment Company by paying the amount directly to the supplier, and to donate the equipments to Nethrodaya at No.47/1, Phase II, Nolambur, Mogappair West, Chennai – 600 037, from the accumulated funds that corresponds to FY 2019-20 which belong to the Trust Estate of Nagai Visalakshi Ammal. 5.Accordingly, these applications are ordered. 05-03-2025 MKN https://www.mhc.tn.gov.in/judis
