HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL
Judgment / Order 03/02/2025 Since, both these writ petitions share similar facts and common questions of law, they have been heard together and are being disposed of vide this common order. Under challenge in these writ petitions is the judgment and decree dated 30.08.2022 passed by the Board of Revenue Rajasthan, Ajmer (for brevity, ‘BOR’) whereby, the appeals preferred by the petitioners have been dismissed.
[2025:RJ-JP:4517] (3 of 4) [CW-19030/2022] The relevant facts in brief are that vide its judgment dated 19.06.1997, the Court of Sub-Divisional Officer, Bayana (for brevity, “learned trial Court”) decreed the suit filed by the petitioners and dismissed the suit filed by the respondents. The appeals preferred thereagainst by the respondents came to be allowed by the Revenue Appellate Authority, Bharatpur vide
judgment and decree dated 05.04.2003 whereby, the matter was remanded back to the learned trial Court for decision afresh after giving both the parties an opportunity to lead their evidence. The appeals preferred thereagainst by the petitioners have been dismissed by the Board of Revenue vide judgment and decree impugned dated 30.08.2022. Eschewing merits of the case, learned counsel for the petitioners submits that he would feel contented, if the learned trial Court is directed to expedite trial and disposal of the suits as the same are pending for last more than 41 years, i.e., since the year 1984. Taking into consideration the limited prayer made by the
learned counsel for the petitioners and life of the suits, these writ petitions are disposed in following terms without issuing notice to the respondents to obviate further delay and not to enburden them with any unnecessary litigation expenses:
“(1) The Court of Assistant Collector, Ucchain (Bharatpur) is directed to expedite trial and disposal of
the suit no.172/2022:Jang Bahadur Vs. Sujan Singh and Others and the suit no.173/2022: Sujan Singh vs. Jang
[2025:RJ-JP:4517] (4 of 4) [CW-19030/2022] Bahadur expeditiously; preferrably, within a period of two years from the date of communication of this order.” Pending application(s), if any, also stands disposed of accordingly.
