Respondent No.1-plaintiff had filed a suit for change of date of birth in the matriculation certificate as well as in the service record. The said suit was filed in the year 1996 and was dismissed by the trial Court. The First Appellate Court had allowed the appeal and set aside the judgment of the trial Court and decreed the suit of the plaintiff. 2. On 19.01.2024, a Coordinate Bench of this Court had directed the State to verify as to whether respondent No.1 has retired from service on attaining the age of superannuation or not. There is no interim order in the present appeal filed. 3. Learned State Counsel, in pursuance of the order passed by the Coordinate Bench of this Court, on written instructions, has submitted that respondent No.1-plaintiff had retired from the Government service on 28.02.2013 (A.N.) on attaining the age of superannuation i.e., 58 years. It is submitted that in view of the same, the present appeal be disposed of at this stage but liberty be granted to the appellant to revive the appeal in case any cause arises in future. 4. Keeping in view the abovesaid facts and circumstances, the present appeal is disposed of at this stage with liberty aforesaid. 5.
