Roop Singh Meena, Aged About 21 Years, R/o Baglai, District Sawai Madhopur, Rajasthan. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Arvind Balaut For Respondent(s) : Mr. Amit Poonia, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 18/03/2025
1. Apprehending his arrest in connection with FIR No. 496/2024 registered at Police Station Jawahar Circle, District Jaipur City (East) for the offence(s) under Section 376(1) of IPC and Sections 69, 70(1), 115(2), 127(2) and 352 of BNS, the accused-petitioner has preferred this anticipatory bail application under Section 482 BNSS.
2.
Learned counsel for the accused-petitioner submits that accused-petitioner has falsely been implicated in this case. It is contended that the accused-petitioner and the prosecutrix were in consensual relationship. It is alleged against the accused- petitioner that in pretext of marriage, the accused-petitioner established sexual relationship with the prosecutrix. It is also contended that the prosecutrix lodged an FIR naming three persons and also alleged that the co-accused Amit Meena also committed rape with her. The police did not find commission of
[2025:RJ-JP:12248] (2 of 3) [CRLMB-14806/2024] any offence against the other co-accused Amit Meena. It is also contended that the prosecutrix in her statement rendered under Section 183 BNSS has not named the other co-accused Amit Meena. The accused-petitioner is ready and willing to cooperate with the investigation and custodial investigation of the accused- petitioner is not required, therefore, the anticipatory bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the anticipatory bail application and contended that the prosecutrix in her statement rendered under Section 183 BNSS has clearly stated that the accused-petitioner committed rape with her, therefore, the anticipatory bail application of the accused- petitioner may be dismissed. 4. Heard and perused the material available on record. 5. Initially, the FIR was lodged against the accused-petitioner and the other co-accused. It is alleged in the FIR that co-accused Amit Meena also committed rape with the prosecutrix. The prosecutrix specifically in her statement rendered under Section 183 BNSS has denied about commission of rape by other co- accused Amit Meena, therefore, considering the above facts, without further commenting on the merits, I deem it just and proper to allow the anticipatory bail application of the accused- petitioner. 6. Accordingly, the anticipatory bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of the petitioner Shiv Singh Meena S/o Sh. Roop Singh Meena, in connection with FIR No. 496/2024 registered at Police Station
