Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 13/02/2025
1. The instant bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.154/2024 registered at Police Station Ghatoli, District Jhalawar for the offence punishable under Section 304B of IPC. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submit that marriage of the petitioner was solemnized with the deceased in the year 2019 in mass marriage ceremony and from this wedlock, one female child was born who is aged about 3 months at the time of alleged incident. It is submitted that victim left her matrimonial home along with her daughter on 14.03.2024 without informing anyone. Learned counsel contend that in these circumstances, an MPR was submitted by the
[2025:RJ-JP:6628] (2 of 3) [CRLMB-14773/2024] petitioner at Police Station Ghatoli, District Jhalawar. Proper information was also furnished to the family members of deceased. It is contended that about 45 days, a skeleton was recovered in the forest and on the basis of saree, same was identified by family members of deceased. It is further contended that as per PMR, it has been opined that cause of death is asphyxia due to ligature mark. Learned counsel argue that during the aforesaid period of 45 days, no complaint was made by family members of deceased with regard to the cruelty or harassment of the deceased in her matrimonial home on account of demand of dowry. It is argued that only after the recovery of skeleton, false allegations have been levelled against the petitioners with regard to the harassment or cruelty in the matrimonial home in connection with demand of dowry. It is further argued that petitioner is in custody since his date of arrest. Charge-sheet has been filed and trial will take time in its conclusion. Further custody of the petitioner would not serve any fruitful purpose. 3.
Learned Public Prosecutor opposes the submissions made by the counsel for the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, as also considering the material available on record in the form of charge-sheet, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6. This bail application is accordingly allowed and it is directed
