JUSTICE NARENDRA SINGH DHADDHA Order 16/01/2025 Matter comes up on an application (I.A. No.1/2024) filed by the petitioners-defendants (for short 'the defendants') under Order 22 Rule 4 CPC. Application is allowed for the reasons mentioned therein and the legal representatives of the deceased respondent No. 1 Shri Gyanaram as described in Para No.2 of the application are taken on record. Amended cause title which is filed with the application is taken on record. This civil writ petition has been filed by the defendants against the order dated 29.09.2018 passed by Additional District Judge No. 14, Jaipur Metropolitan (for short ‘the appellate Court’) in civil misc. appeal No. 307/2018 whereby the appellate court while partly allowing the appeal filed by the plaintiff-respondent No. 1 (for short ‘the plaintiff’) and partly set aside the order dated 18.08.2018 passed by the trial Court in civil misc. application No. [2025:RJ-JP:2310] (3 of 3) [CW-23812/2018] 149/2012 and restrained defendant No. 8 to issue electricity connection to the defendant Nos. 1 to 7 in any manner. Learned counsel for the defendants submits that on account of stay order dated 22.05.2019 passed by this Court, they have got the electricity connection. Taking into consideration the facts and circumstances of the case and more particularly in view of the fact that the suit was filed before the trial Court in the year 2012, thereafter 12 years have been passed, without interfering with the impugned order I dispose of the present civil writ petition with direction to the trial Court to decide the suit, if pending with it, expeditiously, in accordance with law.
