1. The present petition has been filed under Section 483 of BNSS for grant of regular bail to the petitioner in FIR No.108 dated 26.12.2024, under Section 66-E of the Information Technology (Amendment) Act, 2008 RAKESH KUMAR 2025.04.03 17:41 I attest to the accuracy and authenticity of this

Learned counsel appearing on behalf of the petitioner submitted that it is a case where the petitioner is in custody for 2 months and 7 days and investigation of the case has already been completed and thereafter report under Section 173 Cr.P.C has been submitted before learned Court below and thereafter the matter has been sent for committal before the learned Sessions Court. He submitted that the petitioner is the husband and the complainant is his wife and as per the allegations, there was a dispute between them and some private pictures of the complainant were uploaded as status on the WhatsApp and some were sent to the relatives. He submitted that in fact the matter has since been compromised between the husband and the wife as per Annexure P-2 and therefore, no useful purpose will be served in case the custody of the petitioner is further elongated.

On the other hand, Mr. Vishal Kashyap, learned DAG, Haryana appearing on behalf of the State of Haryana submitted that so far as the custody of the petitioner is concerned, the same is correct and it is also correct that the investigation of the case is complete and report under Section 173 Cr.P.C has already been submitted before the learned Court below. He submitted that as per the allegations the petitioner has put some photographs of his wife on the WhatsApp as a status and some were also sent to the relatives but he is not aware of the fact as to whether the matter has actually been compromised between the parties or not.
4. Mr. Hunar Veer Sharma, Advocate has appeared on behalf of the complainant and has submitted that he has instructions to state that the RAKESH KUMAR 2025.04.03 17:41 I attest to the accuracy and authenticity of this

CRM-M-14407-2025 (O&M) -3- matter has been amicably settled between the parties and there is no grievance against the petitioner as of now.

After hearing the learned counsels for the parties and in view of the fact that as per the learned counsel for the petitioner and the learned counsel for the complainant, the matter has been settled between the parties who are none other but husband and wife and the investigation of the case has already been completed, therefore, this Court deems it fit and proper to grant regular bail to the petitioner.
6. Consequently, the present petition is allowed. The petitioner shall be released on regular bail subject to furnishing bail bonds/surety to the satisfaction of the learned trial Court/Duty Magistrate concerned.
7.
