Chatterjee, Advocate ---- 04/10.10.2025 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State. 2. The petitioners are apprehending their arrest in connection with Complaint Case No.220 of 2021, for the alleged offences registered under Sections 26(1)(g), 41 and 42 of Indian Forest Act, 1927 (Bihar Amendment Act, 1989) and Section 27, 29 and 51 of Wild Life (Protection) Act, 1972 pending in the Court of learned Judicial Magistrate 1st Class, Koderma. 3. Learned counsel appearing for the petitioners submits that the allegations are made of excavation of mica scrap and during excavation the said mica mine has fallen down and pursuant to that persons present there have received the injuries. He further submits that the petitioners have also received the injury and in view of that their name has been stated in the offence report. He then submits 2025:JHHC:31375 --2-- A.B.A. No. 5946 of 2025 that the petitioners have got no criminal antecedent as disclosed in paragraph No.15 of the petition. 4. Learned counsel appearing for the State opposes the prayer and submits that in the said accident due to falling of the mines four persons have died. He submits that the petitioners were also present on the spot. 5. Considering that the petitioners have got no criminal antecedent as disclosed in paragraph No.15 of the petition and they have also received the injury and their name has come only on the basis of some unknown sources, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Koderma in connection with Complaint Case No.220 of 2021, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
