CMP(M) No. 2120 of 2025 For the reason stated in the application, which is duly supported by an affidavit of the applicant/appellant, this application is allowed and the delay in filing the application for restoration of the appeal is condoned. The application stands disposed of. CMP No. 29726 of 2025 This application under Order 9 Rule 9 of the Code of Civil Procedure has been filed by the appellant for restoration of the appeal. In the application, it has been mentioned that the appellant is ready to deposit the Court fees. We had given justified reasons in the order dated 04.03.2025 that extension of time for three months had been given to the appellant to deposit the court fees in the year 2018 and thereafter, no positive steps were taken by the appellant to do the needful. Thereafter, notice was also issued to him for
01.05.2019 to make good the deficiency of the Court fees. After a period of five years, we dismissed the appeal on account of non-prosecution on 04.03.2024. In these circumstances, we conditionally allow the application and direct the restoration of the appeal to its original number, subject to deposit of the requisite Court fees, within a period of two weeks from today. In case, the needful is not done, the order dated 04.03.2025 shall come into force. The application stands disposed of.
