THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 25712 of 2025 ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent police in continuously interfering with the personal life and liberty of the petitioners and his family members, and harassing the petitioner at the behest of the 4th respondent, despite clear and binding directions passed by this Hon'ble Court in W.P. No. 6280 of 2025 and during the pendency of Contempt Case No. 1714 of 2025, as illegal, arbitrary, high-handed, and violative of Articles 14 and 21 of the Constitution of India, and consequently direct the 1st and 2nd respondents to take appropriate departmental and legal action against the erring police officials, including the subordinates of the 3rd respondent, for their willful disobedience of the orders of this Hon'ble Court and for misuse of official powers and further direct the respondents not to interfere in any manner with the personal life and liberty of the petitioners and his family members without following due process of law, and pass….”
2. Heard Sri B.V.Durga Prasad, learned counsel for the petitioners and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned Assistant Government Pleader for Home for the respondents on written instructions would submit that basing on the complaint of one C.Eswaramma, a case in Crime No.40 of 2025 under Section 329(4), 79, 115(2), 351(2) of BNS of V.Kota Urban P.S., was registered on 19.03.2025

against the petitioner No.1. The petitioner No.1 was called to the police station only for the purpose of investigation in the case registered against him. 4. Recording the above said submission, this Writ Petition is disposed of.
However, the police are directed to follow due process of law regarding the crime which is registered against the petitioner No.1. There shall be no order as to costs.
